“It was a miscalculation on his part,” representative for the defendant Mr Carmody said during court proceedings as the 19-year-old faced his charges.
Magistrate Dare dismissed the charge and handed down a 12 month good behavior bond with the expectation that Mr Broderick will attend a driver education program. The former Hennessy Student has taken the last 12 months off from study to work and take a gap year before he moves to Wollongong to attend University next month.
“Get it framed,” Magistrate Dare said in regards to the good behavior bond, “and put it beside your bed so you can be reminded every day of what can happen.”
According to Police on November 6, 2016, they were conducting stationary random breath testing in Sutton Street, Cootamundra as part of the state wide operation “Drink Drive 2.” At 12.18 pm Mr Broderick was stopped whilst driving northbound - towards Young - for the purpose of a random breath test.
Police said the breath test revealed a positive reading and Mr Broderick was arrested and taken to Cootamundra Police station for a more accurate breath analysis.
Police said at 12.53pm a breath analysis was conducted at Cootamundra Police Station revealing a reading of 0.033 grams of alcohol per 210 litres of breath. At the time Mr Broderick was pulled over he held a NSW Provisional Class C (P2) licence. Mr Broderick was issued with a Field Court Attendance Notice.
Police said in relation to his drinking that Mr Broderick indicated he consumed about 15 schooners of Carlton Dry beer, starting at about 4pm on November 5, 2016 and had his last drink at about 1am November 6, 2016 at which time he stopped drinking in an effort to be able to drive the following day.
