Darren Gledhill pleaded guilty to the charge of assault occasioning actual bodily harm when he faced Magistrate Peter Dare SC via audio-visual link.
Magistrate Dare convicted the defendant and took into consideration the time Gledhill had already been in custody, back-dating his sentence from January, meaning Gledhill is currently eligible for parole.
According to police facts tendered in court Gledhill and the victim in the incident had shared some animosity between them before Gledhill was arrested on January 10, 2017.
The incident that led to Gledhill ending behind bars occurred on Tuesday January 10, when a relative of Gledhill’s yelled abuse at the victim over the fence between the pair’s property.
The victim challenged Gledhill and other’s over the fence over the child’s behaviour resulting in Gledhill yelling abuse and derogatory comments at the victim.
The victim used the camera on his phone to record the incident before police arrived at the scene a short time later and spoke with Gledhill and the victim.
Police said they spoke to Gledhill and gave him advice to which he replied, “I don’t care, I am (expletive) going to bash him,” before he began yelling abuse at police.
In the facts police said they left to attend to a more pressing matter with the intention of following things up later.
Gledhill continued the yell abuse at the victim who became increasingly fed up with the situation and approached the fence between the properties, continuing to film the interaction between the pair.
Gledhill threatened to punch the victim leading to him asking if that was a threat.
“No, that’s a promise,” Gledhill replied just before he stormed up to the fence and reached over to punch the victim in the face.
The victim retreated to his residence and called police.
The victim sustained a swollen and bloody nose which required treatment by paramedics.
The victim provided police with a statement as well as the recordings from his phone.
Police later arrested Gledhill and took him to Young Police Station where he was refused bail and taken into police custody.
