Dimity Barrett was convicted in her absence by Magistrate Peter Dare SC in Young Local Court after police said they had attended Barrett’s address on 21 separate occasions from January 17 in relation to noise complaints.

According to police the 24-year-old from Young had been accused of playing amplified music and loud yelling and screaming of intoxicated guests could be heard by Barrett’s neighbours in the late hours of the evening and early hours of the morning.
Barrett declined several times advice from police in offering assistance with removing the unruly guests from the property and was also issued with separate day noise abatement directions in accordance with the protection of the environment operations act 1997.
Barrett was also issued four infringements by police for breaches of the noise abatement directions.
According to police Barrett paid the advice, direction and infringements no heed and continued to show complete disregard for the law and comfort of her neighbours, who are elderly and have young children.

About 11.05 pm on March 2017, police attended accused’s address in relation to yet another noise complaint.
Police stopped three houses away from the Young residence – about 40 m from the property – and could clearly hear loud amplified music along with people yelling.
Police spoke with Barrett who said, “look, I don’t care, I have a lot of stuff going on.”
Police issued a court attendance notice for breaching a 28 day noise abatement direction which was issued on Feb 19.
A fresh 28 day noise abatement direction was issued.
About 2.30 am on Saturday March 18, police again attended the premises in relation to a noise complaint.
Again, police stopped three houses away and could hear loud amplified music coming from the premises.
When Barrett was spoken to she said “it’s not that loud.” Police entered the residence upon invitation and removed stereo equipment.
Police had attempted to resolve the matter outside of Court however said Barrett could not be reasoned with and was determined to not comply with the Law.
