William Nichols had left a message in his file for Magistrate Dare to look over in regards to being caught driving with his licence suspended. Magistrate Dare looked over the police facts and convicted Nichols as well as implementing a $250 fine and disqualifying him from driving for 3 month.
Police facts tendered in court said about 10.30 am on Monday February 27 police were patrolling the township of Young and observed Nichols travelling on Campbell Street and began to follow the vehicle. Checks revealed intel for driving offences and drugs so police activated their sirens and pulled Nichols over informing him that they believed his licence was suspended. Nichols produced a CP2 licence and told police he didn’t know his licence was suspended.
Nichols’ random breath test returned a negative result however when tested for drugs he produced a positive detection to methamphetamine and was arrested and taken to Young Police Station. Nichols provided a second sample that was tested at the station and returned a negative result for cannabis but positive for methamphetamine. The remainder of the sample was sent to the NSW Forensic and Analytical Science Service at Lidcombe for analysis.
Nichols was charged with driving whilst suspended while police waited for the results of samples sent for analysis.
