The male had previously plead guilty to the charge of drive recklessly/furiously or speed/manner dangerous.
Magistrate Michael O’Brien took into consideration the young man’s attendance at the Driver Offenders Intervention Program run through the PCYC before he convicted the driver and fined him $400. The P-plater was also disqualified from driving for 12 months and entered into a 12 month s9 bond.
According to police facts submitted to the court about 8.28 pm on Thursday April 20 police were conducting stationary speed enforcement on the Hume Highway at Tumblong when they saw a sedan pass their location travelling faster than the speed limit.
Police were able to see that there was a red P-plate attached to the rear of the car as it overtook vehicles and estimated the speed of the vehicle to be about 170 km/h.
The police speed radar showed the car was travelling at 171 km/h.
Police caught up with the vehicle and pulled it up where police observed three occupants in the vehicle – two males and one female. After police checked the driver’s licence they questioned the driver about his manner of driving to which he replied, “I was speeding.”
A check of the motor vehicle showed the rear near side tyres were devoid of tread with one so bad there was wire and canvas showing through the thin rubber. When police showed the driver he appeared completely unaware of their condition.
Given the extreme speed of an inexperienced driver with only three months driving experience (without a supervising driver), that he had two young passengers on board, that the rear tyres were devoid of tread and showing canvas and wire and the volume of traffic given the amount of heavy and light vehicles travelling in the same direction the potential risk for a catastrophic accident was high.
