He was stopped driving the Olympic Highway at Wombat about 2.55pm on Saturday, May 18.
It's alleged his vehicle overtook an unmarked police vehicle at high speed.
He was stopped and subjected to a breath test that returned a positive reading, while inquiries revealed the driver is disqualified until September 18 this year.
A secondary test revealed a low-range reading of .079. He was charged.
