The NSW Resources Regulator commenced prosecution proceedings against Young Mining Company Pty Ltd for two alleged contraventions of the Mining Act.
"The Regulator is alleging that Young Mining failed to comply with a condition of its mining authorisation in relation to the payment of rehabilitation security and failed to comply with a statutory notice issued under the Act," a Department spokesperson said.
The matter is now referred to the courts with the two matters set down to appear for mention in Young Local Court on March 3, 2020.
"Each offence carries a maximum penalty for the company of up to $1.1 million," the spokesperson said. "As the matter is now before the Court, further details will not be released."
In August 2016 the mine was previously ordered to suspend all mining operations and had their licence suspended for failing to pay outstanding environmental rehabilitation security deposits.
