As a result Hilltops is referring Cr Stadtmiller to the office of Local Government.
Councillor John Horton moved council take the action.
The request for an apology from Cr Stadtmiller began earlier this year and in May at its Ordinary meeting the council moved to formally censure Cr Matthew Stadtmiller for his conduct in relation to what it believes have been breaches of S440G of the Local Government Act.
The motion was seconded by Cr Tony Flanery.
Councillors Stadtmiller and John Walker voted against the motion.
According to a report tabled at the May meeting a continuation of Cr Stadtmiller's actions "will bring him into conflict with the provisions of the Code, Local Government Act 1993, and other relevant instruments, including but not limited to the ICAC Act 1988".
Council voted for councillor Stadtmiller to receive counselling.
According to Council Cr Stadtmiller is to undertake counselling to "ensure he is fully aware of the fact that a continuation of his conduct will result in a situation where he may be denied access to information where there is a reasonable degree of risk that the release of that information will bring the Council into conflict with its legislative responsibilities and obligations".
During counselling Councillor Stadtmiller is to be made "fully aware that where he adversely names or, provides sufficient information to identify an employee of Council, that conduct may cause conflict with his obligations under the Work Health and Safety Act 2011 and that this conduct is not in the interests of the community and nor is it in the public interest".
Council made public its decision "due to the serious nature of these breaches".
Council also voted to develop a social media policy and records management policy as soon as practicable.
